Terms of Service

This is a working draft. It has not been reviewed by a lawyer licensed in Alberta. It describes what we actually do, and we publish it so you can read it — but if you are relying on it for a legal question, say so and we will get it reviewed properly.

These terms govern your use of AgentumGroup's website and services. By signing a proposal with us, using our services, or interacting with an AI agent we operate, you agree to them. If you're agreeing on behalf of a business, you confirm you have the authority to do so.

We're a small agency based in Alberta, Canada, serving businesses across North America. We keep these terms short and honest — read them.

The specifics of what you're getting — features, scope, service levels — live in your proposal. If the proposal and these terms conflict, the proposal wins for that engagement.

4. Fees and payment

Fees, billing frequency, and payment method are set out in your signed proposal. Unless the proposal says otherwise:

Taxes (GST/PST as applicable) are added where required.

5. Third-party services

Our stack relies on third-party providers (voice AI, telephony, language models, hosting). We choose them carefully, but we don't control them. Outages, changes, or terminations on their side may affect the service; we'll work in good faith to restore or replace affected functionality.

6. No guarantee of results

We build tools that answer calls and capture leads. We do not guarantee any particular business outcome — call volume, lead volume, conversion rate, revenue, or anything else. AI agents are good but not perfect: they can mishear, misunderstand, or occasionally produce wrong answers. The service is provided "as is" and "as available," without warranties beyond what your proposal expressly states and what Alberta law doesn't allow us to disclaim.

To the maximum extent permitted by law:

Nothing in these terms limits liability that can't be limited under applicable law, including for fraud or willful misconduct.

You'll defend and indemnify us against third-party claims arising from your business operations, your content, or your breach of these terms — including claims by your customers about work you performed or prices you charged.

We may update these terms from time to time. We'll post updates here with a new date, and material changes will be communicated to active clients. Continued use after the effective date means acceptance.

12. Governing law and disputes

These terms are governed by the laws of Alberta and the federal laws of Canada applicable in it. Courts of Alberta have exclusive jurisdiction, and both parties attorn to them. Talk to us first, though — most issues get fixed with an email.
